Both Polish and international law in force in Poland forbids discrimination based on ethnic and racial origin, sex, religion or nationality. Persons under the jurisdiction of the Republic of Poland are, therefore, protected by the Constitution, labour law, civil law and penal law.

In reference to international law, Poland is a State Party to the conventions forbidding unequal treatment, e.g. the United Nations International Convention on the Elimination of All Forms of Racial Discrimination. Ratified agreements are the source of law and therefore, their provisions may be referred to before the Polish courts.
